Delaware House of Representatives member Ed Osienski and Delaware Senate member Trey Paradee introduced House Bill 150 (HB 150) on Thursday, which would legalize recreational marijuana in the First State if passed.

Osienski and Paradee said the bill is not meant to be a money-maker for the state but rather an effort to snuff out the illegal street market, spur job creation and economic development and ensure that underserved communities benefit from legalization. Similar to alcohol, consumers must be 21 years of age or older to purchase marijuana, and purchases would be limited to a maximum of one ounce.

Anyone previously convicted of a marijuana-related offense can have those offenses expunged if the bill is passed. The provision would also apply to anything that was previously illegal, but made legal by the bill. This does not include convictions attached to violent felonies, large-scale marijuana trafficking or sale to minors.

Additionally, laws making it illegal to drive under the influence of marijuana, grow marijuana at home and use marijuana in public would not change. Employer enforcement will also remain permissible to ensure any zero-tolerance policies and influence or consumption at work are all enforced. [Read more at University of Delaware Review]
